D.A.'s filing says lawyer husband's role in lab case may suggest bias

Of Counsel Richard Zitrin, an expert in legal ethics, is quoted in San Francisco Chronicle in connection with SFPD crime lab controversy. He said while prosecutors have an obvious right to challenge a judge, such an action is risky if it has no merit. "Judges don't like to be accused of bias. That's why you don't see a lot of these," he said. "I would never have done (such a motion) unless I had clear evidence and no other choice," Zitrin said. "This is the kind of thing that no lawyer wants to do half-baked."

Mike McKee | The Recorder | November 13, 2009 * the difficult task this week of deciding whether to approve 45 changes in the Rules of Professional Conduct, including an especially controversial one that would let lawyers seek advance conflict-of-interest waivers from clients.
Thirteen law professors from around the state have come out against the waiver proposal, saying it would put clients in the position of consenting to conflicts that cannot possibly be known.
"The rules are supposed to protect clients, not lawyers," Richard Zitrin, an ethics expert and adjunct professor at Hastings College of the Law, said Wednesday. "This protects lawyers, not clients."
